1. INTRODUCTION
Welcome to Dolvae ("Company," "we," "us," or "our").
Dolvae operates this website and online store, including all related content, information, tools, products, and services (collectively, the "Services"). The Services are hosted and powered by Shopify Inc.
These Terms of Service ("Terms") constitute a legally binding agreement between you and Dolvae and govern your access to and use of the Services, as well as the purchase and use of any products offered through the Services.
BY ACCESSING, USING, OR PURCHASING FROM THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS, INCLUDING THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER SET FORTH BELOW.
If you do not agree to these Terms, do not use the Services.

3. ELIGIBILITY
By using the Services, you represent and warrant that:
You are at least 18 years old
You have the legal capacity to enter into a binding agreement
All information you provide is accurate and current
Purchases are for personal, non-commercial use only, unless expressly authorized in writing by Dolvae
We reserve the right to refuse service, cancel orders, or terminate access for violations of these Terms.
You are responsible for all activity conducted under your account.
4. PRODUCT CATEGORY AND INTENDED USE
The Dolvae cooling throw is a household comfort textile: a lightweight, silk-like cooling nap throw consisting of a breathable cooling-weave face fabric, edged and stitched for durability, and filled with soft polyester. It is intended solely for ordinary personal comfort use by adults as a lap, nap, couch, or bed throw.
The product:
Is a general consumer textile and home-comfort product, and is not a medical device, therapeutic device, or personal-care device
Is intended for use only as an ordinary blanket or throw by adults, consistent with the included care information
Is NOT infant or baby bedding, and is NOT intended for use in a crib, bassinet, or as the sole bedding or sleep surface for an infant or young child
Is described as "silk-like" to convey its soft, smooth feel only; it is not made of silk, and the actual fiber content is stated on the sewn-in product label
You agree to use the product only for its intended purpose and in accordance with these Terms and the care information provided with the product.
5. GENERAL USE AND PHYSICAL SAFETY
This product is a fabric textile filled with polyester, and like all textiles it is flammable. To reduce the risk of injury, fire, or damage, you must:
Keep the throw away from open flames, fire, candles, fireplaces, stovetops, space heaters, halogen lamps, and other high-heat or ignition sources
Treat this as an adult product and keep it away from infants and young children; loose blankets and throws present a suffocation, overheating, and entanglement risk for babies and small children
Never place the throw in a crib or bassinet, and never use it as the sole bedding or sleep surface for an infant or young child
Supervise the area when children or pets are present, and keep the throw away from anyone unable to remove it on their own
Do not use the throw as a wrap or garment while walking, climbing stairs, cooking, or operating machinery, as it may cause tripping, falling, or entanglement
Discontinue use if the fabric becomes damaged, frayed, or otherwise unsafe
6. CARE AND WASHING
Proper care preserves the fabric, the cooling feel, and the polyester fill. You are responsible for following the care information provided with the product and on the sewn-in care label.
Follow the sewn-in care label; in general, machine wash cold on a gentle cycle and avoid wringing or twisting
Do not bleach
Do not use high heat: avoid hot water, high-heat tumble drying, and ironing, and do not dry clean unless the care label expressly permits it, as heat can damage the cooling finish and the polyester fill
Wash separately or with like colors, as dyed textiles may transfer color, particularly on first wash
Damage caused by failure to follow the care instructions, including shrinkage, pilling, fading, or loss of the cooling feel from improper laundering, is considered misuse and is not a manufacturing defect
7. NO HEALTH OR MEDICAL CLAIMS
The Dolvae cooling throw is a general consumer comfort textile. The "cool to the touch" feel of the fabric is a physical and tactile property of the material, which absorbs heat from the skin quickly so that it feels cool when touched. This is a description of how the fabric feels, not a health or medical claim.
The product is:
NOT a medical device, therapeutic device, or health device
NOT intended to diagnose, treat, cure, relieve, reduce, mitigate, manage, or prevent hot flashes, night sweats, menopause, perimenopause, insomnia, sleep disorders, anxiety, or any disease, disorder, symptom, or medical condition
NOT a substitute for professional medical advice, hormone therapy, physical therapy, or licensed healthcare services of any kind
Any references on the Services to "cooling," "comfort," "better sleep," "staying cool," "hot flashes," "night sweats," or "menopause" describe a cool-feeling comfort textile and a customer's subjective comfort preference. They are not promises of any health benefit, symptom relief, or medical outcome. If you experience hot flashes, night sweats, sleep problems, or any health concern, consult a licensed physician. Do not rely on this product, and do not delay or replace medical care, for any health condition.
Individual experiences vary widely. No specific cooling, comfort, sleep, or symptom outcome is guaranteed.
8. PRODUCT SAFETY AND COMPLIANCE
This product is a consumer textile and is sourced from third-party manufacturers. We require our manufacturing partners to provide products that comply with applicable U.S. consumer product safety and labeling requirements for textiles, including:
The Flammable Fabrics Act and 16 CFR Part 1610, where applicable to the product
The Textile Fiber Products Identification Act and 16 CFR Part 303 (fiber content, country of origin, and manufacturer or dealer identification)
The Care Labeling Rule, 16 CFR Part 423 (care instructions)
The Consumer Product Safety Improvement Act (CPSIA), where applicable
Applicable California requirements for textiles, including the prohibition on intentionally added PFAS under the Safer Clothes and Textiles Act (AB 1817)
Any certifications, test reports, fiber-content statements, compliance documentation, or safety representations relating to the materials, fabric, dyes, finishes, fill, or construction of the product originate from the supplier or manufacturer and are supplier representations only. They are not independent compliance attestations made by Dolvae.
No representation or warranty is made by Dolvae that the product meets all applicable safety or labeling standards under all conditions of use. The fabric is described generically as a silk-like cooling-weave face with a polyester fill; the actual fiber content and country of origin are stated on the sewn-in product label.
CALIFORNIA PROPOSITION 65 WARNING: This product can expose you to chemicals including DEHP (di(2-ethylhexyl)phthalate), which is known to the State of California to cause cancer and birth defects or other reproductive harm. 9. ASSUMPTION OF RISK
You voluntarily assume all risks associated with the use or misuse of the product, including but not limited to:
Skin sensitivity, irritation, or allergic reaction to the fabric, dyes, fill, or finishes
Fire or burn risk arising from placing the throw near open flame, heat sources, or ignition sources
Suffocation, overheating, or entanglement risk if the throw is used by, or left within reach of, infants, young children, or pets, contrary to these Terms
Tripping, falling, or entanglement if the throw is worn or wrapped while walking, climbing stairs, or moving
Reliance on the product for any health, comfort, sleep, or symptom outcome, contrary to the No Health or Medical Claims section above
Any injury, loss, or damage arising from misuse, improper use, improper laundering, or failure to discontinue use upon observing any problem
Your purchase and use of this product constitutes your voluntary assumption of these risks.
10. PRODUCT PRESENTATION DISCLAIMER
Product images, videos, descriptions, testimonials, and marketing materials are for illustrative purposes only.
Actual product appearance, color, texture, and feel may vary. Color may differ between screens and from one production run to another due to normal dye-lot variation. The term "silk-like" describes the soft, smooth feel of the fabric and does not represent that the product is made of silk.
Testimonials and reviews about cooling, comfort, or sleep reflect individual experiences and do not represent typical results. No representation is made that any testimonial result is typical or achievable by consumers generally, and no health, comfort, or sleep outcome is implied or guaranteed.
We reserve the right to modify or discontinue products at any time without notice.
11. ORDERS AND BILLING
All orders constitute an offer to purchase and may be accepted or rejected at our discretion.
Orders generally cannot be modified or canceled once placed.
You authorize us to charge your selected payment method for all amounts due.
We reserve the right to cancel orders suspected of fraud, abuse, or unauthorized resale.
12. SHIPPING AND INTERNATIONAL FULFILLMENT
Orders ship directly from international fulfillment partners, primarily located in China, to the customer in the United States. Goods do not transit through Germany at any point.
Dolvae does not maintain warehousing, retail, or fulfillment operations in either the United States or Germany.
You acknowledge that:
Delivery times are estimates, not guarantees
Delays due to customs or carriers may occur
Accurate shipping information is your responsibility
Orders marked as delivered by the carrier are considered fulfilled
13. RETURNS AND PAYMENT DISPUTES
Returns and refunds are governed by our Refund Policy, including the 30-day satisfaction guarantee.
We reserve the right to contest improper chargebacks or abusive dispute behavior.
Customers engaging in excessive or fraudulent disputes may be refused future service.
14. USER CONTENT LICENSE
By submitting reviews, images, videos, or other content, you grant Dolvae a perpetual, worldwide, royalty-free, irrevocable license to use such content for marketing, promotional, and business purposes.
15. INTELLECTUAL PROPERTY
All content on the Services is owned by Dolvae or its licensors and protected by intellectual property laws.
Unauthorized use is prohibited.
16. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE".
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Nothing in this section limits or excludes any warranty or other right that cannot be limited or excluded under applicable law.
17. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM USE OR MISUSE OF THE PRODUCT.
18. INDEMNIFICATION
You agree to indemnify and hold Dolvae harmless from any claims, damages, or expenses arising from misuse of the product or violation of these Terms.
19. INFORMAL DISPUTE RESOLUTION
Before initiating arbitration, you agree to contact support@dolvae.com and allow 30 days for informal resolution.
20. ARBITRATION AND CLASS ACTION WAIVER
Any dispute shall be resolved by binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration shall be conducted on an individual basis
No class actions or representative claims
Arbitration may take place remotely or in New York, New York
Small claims court remains permitted
Opt-Out: You may opt out within 30 days of purchase by emailing support@dolvae.com with your full name and order number.
21. GOVERNING LAW
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, and without depriving consumers of mandatory rights under applicable consumer protection laws, including those of their state of residence.
22. ELECTRONIC COMMUNICATIONS
You consent to receive communications electronically.
23. FORCE MAJEURE
We are not liable for delays or failures caused by events beyond our reasonable control.
24. SEVERABILITY AND ENTIRE AGREEMENT
If any provision is deemed invalid, the remaining provisions remain enforceable.
These Terms constitute the entire agreement between you and Dolvae.
